Cold-call prep
How to brief a case and survive a cold call
- Read the case once for the big picture before you brief it.
- Brief it: facts, issue, rule, holding, reasoning, disposition.
- Skim the notes and questions after the case — cold calls often come from there.
- Know the rule cold and one policy argument on each side.
- If called on, pause two seconds, state the issue, then the rule, then apply the facts.
- It is fine to say "I think, but I am not sure" — never fabricate a holding.
Case-brief template
IRAC cheat sheet
Issue
State the legal question the facts raise. One issue per paragraph; flag sub-issues.
Rule
State the governing rule completely — every element and any exception or definition.
Application
Apply each element to the facts. Use "because" and the parties names. Address counterarguments.
Conclusion
Reach a supported conclusion for each issue. A hedged conclusion is fine if the facts are ambiguous.
